WORKMANSHIP WARRANTY
TERMS & CONDITIONS
Applicable To
THE KREARE DESIGN (Malaysia)
KREARE PTE LTD (Singapore)
1. WARRANTY COMMENCEMENT
THE KREARE DEISGN (for projects in Malaysia) and KREARE PTE LTD (for projects in Singapore), collectively referred to as "KREARE", warrant that all workmanship carried out under an executed Interior Design and/or Renovation Contract shall be free from defects arising from poor workmanship for a period of twelve (12) months from the date the client submits the completed Warranty Registration Form ("Warranty Start Date").
The Warranty Registration Form must be submitted within thirty (30) days of project completion. Failure to submit within this period may result in a delayed or forfeited warranty start date at KREARE's discretion.
2. WARRANTY COVERAGE
This warranty covers defects in workmanship including but not limited to carpentry, tiling, plastering, painting, electrical works, and installation of fixtures supplied and installed by KREARE or its appointed sub-contractors.
For the purpose of this warranty, a "defect" means a fault or failure in workmanship that prevents a completed item from performing its intended function under normal use conditions. This does not include minor cosmetic variations such as slight differences in grout tone, natural wood grain movement, minor paint texture variation, or other characteristics inherent to the materials used.
This warranty covers workmanship only. Products, fittings, and equipment installed carry their own separate manufacturer warranties, which the client should claim directly from the respective brand or supplier. KREARE will where possible assist in facilitating such claims but bears no liability for manufacturer defects.
3. EXCLUSIONS
This warranty does not cover:
-
Defects or damage caused by misuse, negligence, accidents, or alterations made by the client or third parties after project completion.
-
Normal wear and tear, fading, or deterioration of materials over time.
-
Damage resulting from water seepage originating from structural elements beyond KREARE's scope of work.
-
Works carried out by contractors not appointed by KREARE.
-
Defects in materials, fittings, or equipment supplied directly by the client.
-
Acts of God, including floods, earthquakes, or other natural disasters.
-
Damage caused by failure to maintain the premises in accordance with recommended care guidelines.
-
Works or any portion of works for which payment was made directly by the client to a sub-contractor or supplier, whether or not that sub-contractor or supplier was introduced or recommended by KREARE. KREARE's warranty obligation extends only to works procured and paid for entirely through KREARE under the signed contract.
4. CONDITIONS THAT VOID THIS WARRANTY
This warranty will be considered void if:
-
The client carries out renovation, modification, or alteration works to the completed areas without prior written notification to KREARE.
-
The client engages third-party contractors to rectify or modify any works originally carried out by KREARE without KREARE's prior written consent.
-
The client has outstanding payments due to KREARE that remain unsettled at the time a warranty claim is submitted. This warranty is only valid upon full settlement of all amounts owed under the relevant contract.
-
The Warranty Registration Form was not submitted or was submitted with materially inaccurate information.
5. MAKING A WARRANTY CLAIM
To make a warranty claim, the client must:
-
Notify KREARE in writing (via email or official letter) within the Warranty Period, describing the defect in reasonable detail.
-
Allow KREARE reasonable access to the premises to inspect and assess the reported defect.
-
Allow KREARE to carry out rectification works within a mutually agreed timeframe.
-
KREARE reserves the right to assess and determine whether a defect falls within the scope of this warranty before committing to any rectification works.
-
In the event that KREARE attends the premises to inspect a reported defect and determines that the defect does not fall within the scope of this warranty, the client shall be liable for an inspection fee of RM250 (for projects in Malaysia) or SGD150 (for projects in Singapore), covering transportation and labour for the visit. Any materials or additional rectification works required will be quoted separately and will only proceed upon the client's written approval. The client's agreement to proceed with the inspection visit shall constitute acceptance of these charges. Inspection fees stated are effective as of 2026 and are subject to current market rates.
-
The client is responsible for reporting any defect promptly upon discovery and must take reasonable steps to prevent further damage from occurring. KREARE shall not be liable for any damage or loss resulting from the client's failure to report a defect in a timely manner.
6. REMEDY AND POST-RECTIFICATION WARRANTY
Where a valid warranty claim is accepted, KREARE will, at its sole discretion, repair or rectify the defective workmanship at no additional cost to the client.
Rectified works shall carry a warranty of ninety (60) days from the date of completion of rectification, or the remainder of the original twelve (12) month warranty period, whichever is longer. This post-rectification warranty applies solely to the rectified works and does not extend or reset the original warranty.
KREARE shall not be liable for any consequential, indirect, or incidental losses arising from a defect, including but not limited to costs of alternative accommodation, loss of use, or damage to personal belongings.
7. LIMITATION OF LIABILITY
KREARE's total liability under this warranty shall not exceed the total contract value paid by the client for the works to which the claim relates.
8. DISPUTE RESOLUTION
In the event of a dispute arising from this warranty, both parties agree to first attempt to resolve the matter through good-faith negotiation. If the dispute remains unresolved after thirty (30) days from written notification of the dispute, either party may refer the matter to mediation before a mutually agreed mediator, or through the relevant mediation body in Malaysia or Singapore, prior to initiating any legal proceedings.
For projects in Malaysia, this warranty shall be governed by the laws of Malaysia, and any unresolved disputes shall be subject to the jurisdiction of the Malaysian courts.
For projects in Singapore, this warranty shall be governed by the laws of Singapore, and any unresolved disputes shall be subject to the jurisdiction of the Singapore courts.
9. GENERAL
This warranty is non-transferable and applies solely to the original client named in the contract. It does not affect any statutory rights the client may have under applicable consumer protection laws in Malaysia or Singapore.
KREARE reserves the right to update these warranty terms from time to time. The version acknowledged at the time of Warranty Registration Form submission shall apply to that project.
10. SEVERABILITY
If any provision of these warranty terms and conditions is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be severed from the remaining terms. The remaining provisions shall continue in full force and effect and shall not be affected or impaired by such severance.
